FOR THE LOVE OF POOLS, LLC ("Company," "we," "our," or "us") is committed to protecting your privacy and securing your property information. This Privacy Policy explains how we collect, use, disclose, and secure your personal information when you visit our website (forthelovecons.com), request custom swimming pool estimates, or utilize our pool construction, excavation, and hardscaping services. Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the site or engage our pool construction services.
We collect information you provide directly to us in connection with your backyard and swimming pool projects. The information we may collect includes: Personal Data (name, email address, phone number, and physical property address); Property Information (lot dimensions, backyard topography, utility line maps, and HOA architectural guidelines); Financial Data (project estimates, construction deposits, and billing details); Communication Data (records of emails, phone calls, and text messages related to your pool project); and Usage Data (information about how you access and use our website).
We use the information we collect strictly to operate our swimming pool construction business. This includes: conducting initial on-site consultations, preparing 3D pool designs, submitting municipal building permits, scheduling heavy excavation equipment, coordinating specialized subcontractors (e.g., electricians and plumbers), processing project billing, and responding to your direct customer service inquiries. We do not use your personal information to send marketing or promotional communications.
If you opt-in to receive text messages from us, we may send you automated SMS/MMS messages strictly regarding your active swimming pool construction projects or consultation schedules. These operational messages include heavy excavation delivery windows, municipal inspection dates, weather-related delay alerts (e.g., heavy rain pausing concrete shell pours), and secure invoice links. Message frequency varies based on your active construction phase. Standard message and data rates may apply. You can opt-out at any time by texting STOP to any message you receive from us. Text HELP for assistance.
Your consent to receive text messages is completely voluntary. The SMS opt-in checkbox provided on our pool estimate forms or consultation portals is explicitly not mandatory to check. You can secure our pool design and construction services without agreeing to receive text messages. Opting out of text messages will not affect your ability to retain FOR THE LOVE OF POOLS, LLC for your backyard project. We will continue to send essential project communications via email or phone calls.
We strictly protect your mobile data and uphold client confidentiality. Under no circumstances do we share, sell, rent, or trade your mobile phone number or SMS opt-in consent data with any third parties, affiliates, pool equipment manufacturers, or external subcontractors. Mobile opt-in consent data and phone numbers are never shared for any purpose.
We may share your general project information only in the following limited operational scenarios to facilitate your swimming pool construction: Service Providers (sharing necessary jobsite data with trusted municipal building departments for permitting, or licensed specialized subcontractors such as electricians and pool tile specialists); Legal Requirements (if required by law, court order, or local zoning mandates); and Business Transfers (if we are involved in a merger or sale of the company). However, this explicitly excludes mobile phone numbers and SMS opt-in consent data; mobile information is never shared with any third parties under any circumstances.
We implement rigorous technical and organizational security measures to protect your sensitive property and financial information against unauthorized access, alteration, disclosure, or destruction. These measures include secure servers, encrypted digital portals for construction contracts, and strict physical access controls to our Melbourne office records. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
Depending on your location, you may have the following rights regarding your personal information: the right to access and receive a copy of your personal data and project history; the right to correct inaccurate property requirements or contact information; the right to request deletion of your personal information (subject to state construction record retention laws); the right to restrict or object to certain processing of your data; and the right to withdraw consent for administrative communications. To exercise any of these rights, please contact us using the information provided at the end of this policy.
We may use cookies and similar tracking technologies to collect information about your browsing activities on our website. Cookies help us understand how you use our site, remember your pool design preferences, and improve your digital experience. You can control cookie settings through your browser preferences.
Our website may contain links to third-party websites, such as pool equipment manufacturers (e.g., pumps and filters), municipal zoning boards, or HOA portals. We are not responsible for the privacy practices or content of these external sites. We encourage you to review the privacy policies of any third-party websites you visit.
Our swimming pool construction services are directed exclusively to adult property owners and commercial developers. We do not knowingly collect personal information from individuals under the age of 18. If you become aware that a child has provided us with personal information, please contact us immediately so we can delete such information.
We retain your personal, financial, and project data for as long as necessary to fulfill the construction and warranty purposes outlined in this privacy policy, uphold pool structural warranties, maintain accurate financial records, and comply with state and federal business laws. These Terms and Conditions govern your access to our website and your engagement with the swimming pool construction, excavation, and hardscaping services provided by FOR THE LOVE OF POOLS, LLC. By accessing our website, submitting a project inquiry, or using our services, you acknowledge that you have read and understood these Terms and agree to comply with them.
FOR THE LOVE OF POOLS, LLC ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and swimming pool construction, excavation, and hardscaping services. By authorizing site work, signing a pool design proposal, scheduling a consultation, or using our digital portals, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our pool construction services.
We provide professional custom swimming pool construction and outdoor property services for residential and commercial clients. This includes, but is not limited to: 3D pool design, site excavation, shotcrete/gunite concrete shell pours, plumbing, electrical equipment installation, decking, and hardscaping. The specific scope of work, materials, and machinery deployed for your backyard will be defined exclusively by a separate, fully executed written construction agreement.
All pool construction estimates provided by our team are valid for 30 days, subject to material costs and initial site assessments. Final project costs may vary if hidden subterranean conditions are discovered during backyard excavation (e.g., massive rock formations, excessive groundwater, buried debris, or unmarked bedrock). Any major deviations from the original pool engineering plan require a formal, written change order.
Clients are strictly responsible for funding their pool projects according to the milestone payment schedule outlined in their specific contract (e.g., excavation, shell pour, tile, equipment set, interior finish). Deposits are required before securing permits or ordering custom materials. In accordance with Florida law, we reserve the right to apply a statutory mechanic's lien (under Chapter 713, Florida Statutes) to the property for unpaid labor, excavation, or materials.
The Client agrees to provide our heavy machinery (e.g., excavators, dump trucks, concrete mixers) and construction crew with safe, unobstructed access to the jobsite during scheduled working hours. The Client is strictly responsible for removing fences if necessary, clearing debris, and ensuring access paths are sufficiently wide for construction equipment prior to our arrival. The Company is not liable for damage to existing driveways or sidewalks caused by the weight of standard heavy construction trucks.
While we strive to adhere to the estimated construction timeline, all excavation, pouring, and finishing dates are approximate. The Company shall not be held liable for delays caused by factors beyond our reasonable control, specifically severe weather conditions (e.g., heavy rain or hurricanes creating unsafe conditions for concrete pours or excavation) or municipal permitting delays.
An active pool construction site involves deep open pits, exposed rebar, and heavy machinery. Clients, their children, their pets, and their guests must maintain a safe distance from the active construction zone at all times. The Client is responsible for maintaining temporary safety fencing as required by local Florida building codes until the permanent pool barrier is installed.
You agree to accurately identify property lines and authorize excavation work only if you are the legal owner of the site. Crucially, the Client is responsible for marking all private underground utilities prior to our digging, including septic tanks, private irrigation/sprinkler lines, and private lighting wires. The Company is explicitly not responsible for damage to unmarked private subterranean lines. We will contact Sunshine 811 for public utility locates as required by law prior to any excavation.
The Company maintains comprehensive general liability insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any pool construction project is strictly limited to the direct cost of correcting our specific scope of work. We are explicitly not responsible for pre-existing structural foundation issues on your home, soil erosion outside our work zone, or any indirect, incidental, consequential, or punitive damages.
If you voluntarily opt-in to receive text messages from us, you agree to receive automated SMS/MMS messages strictly for operational project management, including heavy machinery delivery windows, weather-related schedule changes, municipal inspection alerts, crew arrival estimates, and secure invoice links. We do not use text messaging for marketing or promotional campaigns. Message frequency will vary based on the active phase of your pool construction project. Message and data rates may apply. You can opt-out at any time by replying STOP. Text HELP for assistance.
Your consent to receive these text messages is completely voluntary. The SMS opt-in checkbox on our pool inquiry forms is explicitly not mandatory. Opting out will not affect your ability to contract with us for your backyard project. We strictly protect your mobile data. We do not share, sell, rent, or trade your mobile phone number or SMS opt-in consent data with any third parties, affiliates, pool equipment suppliers, or external subcontractors for any purpose.
All 3D pool designs, CAD engineering blueprints, custom hardscape renderings, and project photography created or provided by FOR THE LOVE OF POOLS, LLC remain the exclusive intellectual property of the Company. These materials are provided solely for the execution of your specific project and may not be reproduced, distributed, or utilized by third-party contractors without our express written permission.
These Terms and Conditions and all pool construction contracts shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal disputes arising from our services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state courts located in Brevard County, Florida.
You agree to fully indemnify and hold harmless FOR THE LOVE OF POOLS, LLC, its operators, crew members, and staff from any claims, damages, or liabilities arising from your failure to secure necessary Homeowner Association (HOA) architectural approvals for the pool, or your failure to mark private underground utilities. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
